1.Introduction and acceptance
PopIn is a social events platform that lets you create events, invite guests by email or SMS without requiring them to have an account, post updates, send messages, and connect with friends. PopIn is operated from Australia. References to "we", "us" and "our" mean PopIn; references to "you" and "your" mean the person using the Service.
By creating an account, by using any feature of the Service, or by responding to a PopIn invitation as a guest, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree you must not use the Service.
Minimum age. The Service is intended for people aged 16 and over. If you are under 16 you may use the Service only with the active involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf. We do not knowingly create accounts for children under 13.
We may update these Terms from time to time. When we do we will revise the "Last updated" date above and, for material changes, give you reasonable notice (for example by email or by an in-app notice). Your continued use of the Service after a change takes effect means you accept the updated Terms.
2.User accounts
To use most features of PopIn you will need to register an account. When you register you agree to:
- provide accurate, current, and complete information;
- choose a username and display name that do not impersonate another person, brand, or organisation, and that are not offensive, misleading, or designed to harass others;
- keep your password confidential and not share it with anyone else;
- not share or transfer your account, and not let anyone else sign in as you; and
- take responsibility for everything that happens under your account, including content posted, events created, and messages sent.
If you believe your account has been accessed without your permission, you must tell us as soon as possible. You may change your password and other account settings at any time from the Settings area of the Service.
3.Guest access (no account)
A core feature of PopIn is that an event host can invite anyone by email or SMS, and the guest can respond without creating a PopIn account. If you receive a PopIn invitation as a guest, these Terms still apply to your interaction with the invite link and the information you choose to provide.
What we collect from guests. When you respond to an invitation as a guest we collect the name you provide, your RSVP status, any plus-ones you indicate, and the email address or phone number used to deliver the invitation. We also receive basic technical information automatically (such as your IP address) so that the Service can function.
Use of guest data. We use guest information only to deliver the invitation, record your response, share your response with the host of the event, and send you reminders or updates about that event. We will not use your contact details to market unrelated PopIn features to you.
Your rights as a guest. You can ask us to delete your guest record at any time by contacting us using the details in section 13. We retain guest records for 12 months after the event date and then delete them, unless an earlier deletion is requested.
4.User-generated content
PopIn lets you create posts, comments, events, messages, and other content ("User Content"). You retain ownership of your User Content. By posting it to the Service you grant PopIn a worldwide, non-exclusive, royalty-free licence to host, store, display, distribute, and otherwise use that content for the limited purpose of operating, improving, and promoting the Service. This licence ends when you delete the content, except where the content has been shared with other users (in which case we may retain copies only for as long as needed to deliver the Service to those users).
You are responsible for the User Content you submit. You must have all the rights necessary to submit it, and it must not:
- infringe anyone's intellectual property or privacy rights;
- be unlawful, defamatory, threatening, harassing, hateful, or discriminatory;
- be sexually explicit, depict graphic violence, or be otherwise inappropriate for a general audience;
- promote illegal activity, self-harm, or the abuse of any person;
- attempt to impersonate any person or organisation; or
- contain malware, spam, or unsolicited commercial messages.
We may remove User Content that we reasonably believe violates these Terms, and we may take action against accounts that repeatedly post such content, up to and including suspension or termination. We are not obliged to monitor User Content, but we reserve the right to do so.
5.Events
PopIn helps you organise events in the real world. We are not the organiser, sponsor, or host of any event created on the Service; the host is the user who created it. Hosts are responsible for their event's lawfulness, safety, accuracy, and conduct.
As a host you agree to:
- provide accurate event information including location, date, time, and any access requirements;
- comply with all applicable laws relating to running the event (including those relating to alcohol, public gatherings, ticketing, and licensing);
- handle guest contact details (such as RSVP emails or phone numbers) only for the purpose of running the event; and
- promptly notify your guests of any material change or cancellation.
Guest lists and visibility. Each event has a visibility setting (such as public, friends, or invite-only) that controls who can see the event and its guest list. By contributing as a guest you agree that your RSVP and (if applicable) your name and avatar may be visible to the host and to other guests according to the event's visibility setting.
PopIn's role. PopIn provides the platform on which events are organised. To the maximum extent permitted by law we are not responsible for what happens at any event, including injuries, damage to property, disputes between attendees, or any failure of an event to take place.
6.Communications
By using PopIn you consent to receive electronic communications from us. These fall into two categories.
Transactional communications include email verification, password resets, security alerts, event invitations, RSVP confirmations, and event reminders. These messages are necessary for the Service to work and you cannot opt out while you keep an active account or an active RSVP.
Optional communications may include digests, tips, and updates about new features. You can opt out of these at any time from the notification preferences in your Settings.
SMS messages are delivered through our partner Twilio and may incur standard message and data charges from your mobile carrier. Email messages are delivered through our partner SendGrid. Replying STOP to a non-essential SMS will unsubscribe you from that category of messages.
7.Privacy and data
Our handling of your personal information is described in the Privacy Policy, which forms part of these Terms.
In short, we collect the information you provide when you sign up (such as your email address and display name), the content you create on the Service, basic technical information about your device, and information from third-party providers we rely on to deliver the Service. We use this information to run, secure, and improve PopIn, and we do not sell it. Some information is shared with the third-party services listed in the Privacy Policy so we can deliver features such as email, SMS, maps, GIF search, and AI-assisted event creation.
8.Prohibited conduct
When using PopIn you must not:
- harass, stalk, intimidate, dox, or threaten any other person, on or off the Service;
- post hate speech, slurs, or content that targets people on the basis of race, ethnicity, national origin, religion, disability, gender identity, sexual orientation, age, or any other protected characteristic;
- use the Service to send unsolicited bulk messages, advertising, or scams;
- scrape, crawl, or otherwise extract data from the Service by automated means without our prior written consent;
- impersonate any person or misrepresent your affiliation with another person or organisation;
- attempt to gain unauthorised access to any account, system, or data, or to interfere with the normal operation of the Service;
- reverse engineer or attempt to circumvent any technical measures used to protect the Service;
- upload viruses, malware, or other malicious code;
- do anything illegal under Australian law, or under the law that applies where you use the Service.
We will act on credible reports of prohibited conduct. You can report any such behaviour by using the feedback option in the app or by contacting us at the address in section 13.
9.Termination
You can delete your account at any time from the Settings area. When you do, your account and your User Content are scheduled for deletion in line with the retention timelines set out in the Privacy Policy.
We may suspend or terminate your access to the Service if we reasonably believe you have breached these Terms, if your continued use creates a risk for other users or for PopIn, or if we are legally required to do so. Where it is reasonable we will notify you before we act and give you an opportunity to address the issue.
After your account is terminated, references to you in other users' content (for example a comment you posted on a friend's event) may continue to appear with your name replaced or otherwise dissociated from your account, in line with the Privacy Policy.
10.Liability and disclaimers
PopIn is currently in beta. We use reasonable efforts to keep the Service available, secure, and accurate, but we cannot promise it will always be uninterrupted, free from bugs, or fit for any particular purpose. The Service is provided "as is" and "as available" to the maximum extent permitted by law.
To the maximum extent permitted by law, PopIn is not liable for:
- anything that happens at an event organised through the Service, including loss, damage, or injury;
- User Content posted by other users, including its accuracy, legality, or impact;
- failures or delays caused by third-party services we rely on (such as email, SMS, map, or AI providers);
- loss of data caused by you or by events outside our reasonable control; and
- indirect, incidental, consequential, or punitive damages, including loss of profits or goodwill.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, including those under the Australian Consumer Law.
11.Changes to these terms
We may update these Terms from time to time, for example to reflect changes in the Service, in the law, or in our practices. We will revise the "Last updated" date at the top of this page when we do. For material changes we will give reasonable advance notice (for example by email or by an in-app notice). If you do not accept the updated Terms you should stop using the Service before the change takes effect.
12.Governing law
These Terms are governed by the laws of Queensland, Australia, and any dispute arising out of or in connection with them is subject to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia. If you are a consumer in another country, you may also have rights under the law of that country, and nothing in this clause limits those rights.
Before commencing any formal dispute, you agree to first contact us using the details in section 13 so we can try to resolve the matter informally.
